Warranty:

Warranty applicable only to container vines. We are not liable for crop loss or damage from causes beyond our control, acts of god, drought, insects, or disease. We will gladly replace any stock, up to 3% of the planted total, which proves to be untrue to variety or fails to grow the year that it is installed. We are not responsible for losses sustained during winter conditions,or during shipping, and handling. Under no circumstances is our liability greater than the cost of the stock, and does not include shipping or handling.  orders for pick up or future shipment all booked orders are non- refundable. Orders left at the grower for 60 days beyond the scheduled pick up date are subject to a 20% maintenance/care charge. The seller does not offer free shipping. All shipping charges are the responsibility of the buyer.  Any unforeseen shipping costs that might arise shall be additional to the final purchase price. In the event of a dispute, the buyer and seller waive any right to trial by judge or jury and instead agree to resolution by arbitration by one arbitrator in  Wood county, Texas pursuant to the terms of Texas Code of civil procedure section 171.001. It is mutually agreed that this is the total extent of our liability involving any matter concerning our product upon placement of your order. All claims must be submitted by August, 15th of the year the product is delivered. For losses in excess of 2% we require notice within 30 days of planting so we can verify planting practices.
